Terms and Conditions — Atlin Studios

By using our services you agree to these Terms and Conditions, and you confirm that you are able and competent to agree to them and to comply with them.

Please read them carefully. When you use any current or future Atlin service, these terms apply.

MODIFICATIONS TO THESE TERMS AND CONDITIONS

Atlin reserves the right, at any time and without notice, to add to, change, update or modify these Terms and Conditions. Any such change is effective immediately upon posting. The version published at the time you place your order is the version that applies to that order. We suggest you check these terms periodically.

ORDERS

Placing an order is an offer to buy. A contract is formed only once we send you an order confirmation by email.

We may refuse or cancel an order — for example if a piece is sold out, if there is an obvious error in the price or description, or if we suspect fraud. If we cancel, you are refunded in full.

EDITIONS

Our pieces are made in small, numbered runs. When an edition is sold out it will not be restocked in the same form. Stock shown on the site is indicative; if a piece sells out between your order and our confirmation, we will refund you in full.

OUR ITEMS

The images of the items on the website or mobile are for illustrative purposes only. We have made every effort to display the colours accurately, but we cannot guarantee that your screen displays the colour of the item accurately.

Our pieces are garment-dyed and finished by hand. Variation in colour, wash, and print placement is inherent to this method and is not a fault.

Measurements are given as guidance, taken flat, with a tolerance of approximately 5%.

PRIVACY

Atlin uses personal information such as your name, address, email and phone number only to process and ship your order. Personal information transmitted to us is never sold or shared with third parties, other than the providers we need to fulfil your order (payment providers, shipping carriers, and our email provider). ACCOUNT

If you create an account, it is your responsibility to maintain the confidentiality of your account information and password, and to protect and restrict access to it. You are responsible for all activity that occurs using your account or password.

PAYMENT

All prices are quoted in euros and include Dutch VAT.

We offer the following payment options: iDEAL, Bancontact, Visa and Mastercard.

To protect your personal information we take reasonable precautions and follow industry best practices to ensure it is not lost, misused, accessed, disclosed, altered or destroyed. Credit card information is encrypted using secure socket layer technology (SSL). Although no method of transmission over the internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SHIPPING COSTS

  • Netherlands — free
  • Rest of the EU — €22
  • Rest of the world — €38

Shipping is calculated at checkout. There are no other charges from us.

DELIVERY

Orders are processed and sent within 2 working days. During a launch this may take slightly longer; if it does, we will tell you.

Indicative delivery times once shipped:

  • Netherlands: 1–2 working days
  • Belgium and Germany: 2–4 working days
  • Rest of the EU: 3–7 working days
  • Outside the EU: 7–21 working days

Purchased items are delivered worldwide by our standard delivery service, PostNL. As soon as your order has been shipped you will receive a confirmation with a track and trace number.

Delivery times are estimates, not guarantees. We cannot be held responsible for late deliveries, as this is outside our control.

Atlin does not calculate, invoice or collect any taxes, duties, import fees or charges other than the shipping cost shown at checkout. Orders shipped outside the European Union may be subject to import duties, VAT or handling fees charged by the destination country. These are paid by the recipient. Refusing a parcel because of such charges does not entitle you to a refund of the shipping cost.

RIGHT OF WITHDRAWAL, REFUNDS AND RETURNS

If you are a consumer in the EU you have the right to withdraw from your purchase within 14 days of delivery, without giving a reason.

To return an item:

  • All items must be unworn and unwashed, with all original Atlin tags still attached.
  • Items that have been worn, used, altered or damaged will not be accepted.
  • For reasons of hygiene, socks and other underwear cannot be returned once the seal or packaging has been opened.
  • Notify us at info@atlinstudios.com within 14 days of delivery, quoting your order number. We will confirm the return address.
  • Return the item within 14 days of notifying us.

Atlin reserves the right to refuse the return of any product that does not meet these conditions.

The cost of returning a product is paid by you and is non-refundable. When returning products, please make sure the delivery is traceable — we are not responsible for damage or loss caused by the delivery company before the item reaches us.

Once we have received and inspected your return, we will refund the purchase price, including the standard delivery cost you originally paid, within 14 days.

If your order arrives damaged, faulty or incorrect, email info@atlinstudios.com within 14 days with your order number and a photograph. We will replace or refund it in full, including return shipping.

INTELLECTUAL PROPERTY

All content on this site — photography, text, graphics, garment designs, and the Atlin Studios name, logo and labels — belongs to Atlin Studios and may not be copied, reproduced or used commercially without our written permission. Buying a piece gives you the piece, not the rights to its design.

USE OF THE SERVICES

Atlin reserves the right to monitor any and all use of the services. Atlin also reserves the right to investigate and take legal action against any illegal and/or unauthorised use of the services and/or materials.

LIABILITY

Nothing in these terms limits your statutory rights as a consumer, nor our liability for death, personal injury or fraud. Beyond that, and to the extent permitted by law, our liability for any claim is limited to the value of the order concerned. We are not liable for indirect or consequential loss.

APPLICABLE LAW

These Terms and Conditions are governed by Dutch law. Disputes may be brought before the competent courts in the Netherlands. As an EU consumer you may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

These Terms and Conditions contain the entire agreement between you and Atlin with respect to the subject matter and supersede all prior or contemporaneous agreements, understandings and representations, whether written, oral or otherwise.
